The Board of Whitman County Commissioners also serves as the Whitman County Board of Health in accordance with the public health and safety chapter of the Revised Code of Washington (RCW 70.46.060). The Board has broad legal authority and the responsibility to protect the community's health and to enforce local, state and federal laws and regulations. By selecting and overseeing leadership, working with staff to set policy and priorities, approving the annual operating budget, and enacting health policies through local public health regulations, the Board establishes the overall direction of the Public Health Department. The Board of Health exercises final authority over all matters pertaining to the preservation of the life and health of the people within Whitman County.

 

Board responsibilities include:

  • Enforcement of state public health statutes and the rules of the state board of health and secretary of health

  • Supervision of health and sanitary measures for the provision of the public health

  • Enacting local rules and regulations to preserve, promote, and improve public health and provide enforcement as necessary

  • Control and prevention of any dangerous, contagious or infectious disease within the county

  • Prevention, control and abatement of nuisance detrimental to the public health

  • Secure financial support needed to maintain foundational public health services

  • Establishes fee schedules for issuing or renewing licenses or permits, or for other such services

  • Appointment of a Public Health Officer (RCW 70.05.070)

The Board of Health meetings are held at 2:00 PM the 3rd Tuesday of every other month, in the Commissioners' Chambers on the main floor of the Whitman County Courthouse. The courthouse is located at 400 North Main Street in Colfax, Washington. All Board of Health meetings are open to the public and we encourage your attendance and participation. Legal Authority for Whitman County Board of Health

 

Local health jurisdictions (LHJs) in Washington State are governed by both local and state regulations. The hierarchy of rule making authority is as follows:

  • The Washington State Legislature has the primary legislative authority for public health, developing the Revised Code of Washington (RCW). Usually RCWs provide general intent, assigning detail to a department of state government or another governmental body.

  • A department (Health, Agriculture, Ecology) of state government is granted authority by the Legislature through the RCW to develop administrative rules or chapters of the Washington Administrative Code (WAC).

  • The Washington State Constitution established the Washington State Board of Health (SBOH) with authority to develop Washington Administrative Code. The SBOH has developed the majority of rules for the authority and legislative RCWs governing the operations of public health programs.

  • A local board of health is granted authority by the Legislature through the RCWs to develop local rules and regulations. The local Boards of Health function separately from the SBOH and will often supplement SBOH rules to address local problems. Local board of health rules cannot be less stringent that SBOH rules.
    A local board of health is also granted authority by the Legislature through the RCWs to develop fees to carry out local and SBOH rules.

  • A city is granted authority by the Legislature through the RCWs to develop local ordinances. Cities often have local ordinances governing garbage handling, keeping of livestock, development of wells within the city limits and noise control, which they may request the local health jurisdiction to enforce
